Terms of Use

These Terms of Use (hereinafter “these Terms”) set out the conditions for use of all services provided by TOKU, LLC. (hereinafter “the Company” or “we”). By using our services, you agree to be bound by these Terms.

Our services are intended for users who are 13 years of age or older. Users under 13 may not use our services. If you are a minor, please obtain parental or guardian consent before using our services.

All content on our services — including text, images, design, logos, and code — is protected by copyright and other intellectual property rights belonging to the Company or their respective rights holders.

Reproduction, republication, modification, redistribution, or commercial use without prior written permission is strictly prohibited.

Users must not engage in any of the following when using our services.

• Any act that violates applicable laws or public order and morality
• Any act that infringes on the intellectual property rights, portrait rights, privacy, or other rights of the Company or third parties
• Defamation, harassment, threats, or other harmful conduct toward the Company or third parties
• Placing excessive load on our servers or networks
• Any act that interferes with the operation of our services
• Unauthorized access, cracking, or other malicious activities
• Commercial use of information obtained through our services without prior written permission
• Any other act the Company deems inappropriate

Use of the contact form on this site for sales, advertising, solicitation, or any similar commercial purpose is strictly prohibited.

In the event of a violation, the Company reserves the right to charge an administrative fee of ¥100,000 (excl. tax) per submission. By submitting the form, you agree to this condition.

While the Company makes reasonable efforts to ensure the accuracy, completeness, and usefulness of the information in our services, we do not guarantee its completeness. Content may be changed or removed without notice.

The Company shall not be liable for any damages arising from use of our services, except in cases of intentional misconduct or gross negligence on the part of the Company.

Tabiato

The Tabiato app uses your device's GPS location only during a check-in action to verify whether you are within 500m of the pilgrimage spot. Location access is based on your explicit permission and location data is not stored persistently on our servers. You may revoke location permissions at any time through your device's OS settings.

Tabiniwa

The Tabiniwa app does not request GPS device access permission at all. Only when a photo attached to a diary entry contains location data in its EXIF metadata, we transmit those coordinates to Apple Inc.'s geocoding service (CLGeocoder, USA) for place name conversion, and only the converted place name string is stored. See Article 6 of the Privacy Policy for details.

Some of our services deliver advertisements through Google AdMob. Advertising identifiers (IDFA / GAID) may be used for ad delivery. To opt out of personalized advertising, please adjust your device settings.

The Tabiniwa app offers a paid subscription called “Tabiniwa Premium” which unlocks additional features. This Article sets out the terms of use for that subscription.

(1) Plans and Benefits

• Monthly plan: ¥480 / month (auto-renewing)
• Annual plan: ¥4,800 / year (auto-renewing, includes a 7-day free trial for first-time subscribers)
• Benefits: Unlimited garden creation (free plan is limited to 3 gardens) / Full Garden Collection view / No advertisements

(2) Billing and Auto-Renewal

Subscription fees are charged to your Apple ID at the time of purchase confirmation. Unless auto-renewal is turned off at least 24 hours before the end of the current period, the subscription will automatically renew for the same period and the same amount will be charged to your Apple ID. Renewal pricing follows the plan price at the time of purchase. If we change pricing, we will provide advance notice and obtain consent in accordance with Apple's guidelines.

(3) Free Trial

The annual plan includes a 7-day free trial for first-time subscribers. No charge occurs if the subscription is cancelled during the trial period. If not cancelled at least 24 hours before the end of the trial, the subscription automatically transitions to the paid period and the annual fee will be charged. The free trial is available only once per user (per Apple ID).

(4) Cancellation and Management

Subscription management (cancellation, plan changes, receipt viewing, etc.) can be performed at any time via your iOS device's Settings → Apple ID → Subscriptions. Note that simply deleting the app does not cancel the subscription. After cancellation, Premium benefits remain available until the end of the current paid period.

(5) Refunds

Refunds for subscription fees follow Apple's “Apple Media Services Terms.” The Company cannot directly accept refund or chargeback requests after purchase. For refunds, please contact Apple directly via the Apple refund request page (reportaproblem.apple.com).

(6) Restoring Purchases

If you wish to restore a previously purchased Premium status (e.g., after device change or app reinstallation), use the “Restore Purchases” link displayed on the in-app Paywall screen. You must be signed in with the same Apple ID.

(7) Compliance with App Store Terms

This subscription is purchased through the App Store provided by Apple Inc. Matters not stipulated in this Article are governed by Apple's Apple Media Services Terms.

The Company may modify, add, remove, suspend, or discontinue any part of our services at any time without prior notice. The Company shall not be liable for any damages resulting from such changes or discontinuation.

The Company may revise these Terms as necessary. Updated Terms take effect when posted on this page. Continued use of our services after changes constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Yokohama District Court as the court of first instance.
